PENYULUHAN HUKUM TENTANG PERATURAN POLRI NOMOR 8 TAHUN 2021 TENTANG PENANGANAN TINDAK PIDANA BERDASARKAN KEADILAN RESTORATIF

Abstract

Changes in the paradigm of punishment from
retributive justice which is punitive or retaliatory to the
perpetrators of criminal acts into a paradigm of restorative
justice or restorative justice is a settlement of cases that places
more emphasis on aspects of recovery or improvement of the
consequences arising from the criminal acts that occurred, so
that it is expected to provide justice for all parties without
releasing the perpetrator's responsibility. To maximize the
application of restorative justice in the handling of criminal
cases, the Indonesia National Police have issued Indonesia
National Police Regulation Number 8 of 2021 concerning
Handling of Crimes Based on Restorative Justice, as a legal basis
and guideline in resolving cases based on restorative justice.
However, in reality, restorative justice still cannot be
implemented optimally, one of which is due to the lack of
knowledge and understanding of Indonesia National Polri
members regarding the substance of Indonesia National
Regulation Number 8 of 2021. The targets of this community
service activity in the form of legal counseling are members of
the Indonesia National Police serving at the Pasar Rebo Sector
Police, East Jakarta City Metro Police, and Regional Police
Metro Jaya. The method of community service activities through
direct legal counseling, which in its implementation consists of
the preparation stage, the activity implementation stage, the
evaluation stage, and the reporting stage. The results of this
community service activity are, First, the implementation of
community service activities in the form of legal counseling
regarding Indonesia National Police Regulation Number 8 of
2021 runs in an orderly and smooth manner from the beginning
to the end of the activity without any significant obstacles and
obstacles; Second, this community service activity has increased
the knowledge and understanding of members of the Pasar Rebo
Sector Police regarding the handling of criminal acts based on
restorative justice so that they can become provisions in carrying
out their duties in the field.
